By downloading, installing, or using Undulate ("the app"), you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
Undulate is a breathing exercise application that provides guided breathing animations and haptic feedback. The app offers both free and premium features accessible through a one-time in-app purchase.
Undulate is not a medical device and does not provide medical advice. The breathing exercises are for general wellness purposes only. Consult a healthcare professional before starting any breathing exercise program, especially if you have respiratory conditions, cardiovascular issues, or other health concerns.
If you are a consumer in the EEA or the United Kingdom, you have a 14-day right of withdrawal for digital content purchases. By tapping "Unlock Now" on the paywall and confirming your Apple ID purchase, you expressly request that the premium features be made available immediately and acknowledge that you lose the right of withdrawal once the first premium feature has been used. Refund requests for unused purchases within 14 days should be directed to Apple via the App Store refund process (reportaproblem.apple.com).
You must be at least 16 years old to use Undulate in the European Economic Area, the United Kingdom, or any jurisdiction where the digital-services consent age is 16. In the United States, children aged 13 to 17 may use the app only with the consent of a parent or legal guardian. By using the app, you represent that you meet these age requirements.
All content, animations, designs, and code within Undulate are the property of the developer. You may not reproduce, distribute, or create derivative works from the app's content.
You agree not to:
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the developer from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms, (b) your misuse of the app, (c) your violation of any law or third-party right, or (d) content, claims, or statements you make about the app in public channels. This clause does not apply to claims caused by the developer's willful misconduct or gross negligence, and does not limit mandatory consumer-protection rights in your country of residence.
Undulate is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, the developer's total aggregate liability for any and all claims arising out of or relating to the app shall not exceed the greater of (i) the amount you paid for the app in the twelve months preceding the claim or (ii) ten euros (€10). In no event shall the developer be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, data loss, or personal injury alleged to result from breathing exercises. Nothing in this clause limits mandatory consumer-protection rights in your country of residence or liability for death, personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
Undulate stores all session history and preferences locally on your device. We do not sync to the cloud or store any data on external servers. You are solely responsible for maintaining backups of your device, including enabling iCloud Device Backup if you wish to preserve your session history across devices or after a device reset. We shall not be liable for loss of session data resulting from device failure, theft, iOS reinstallation, app deletion, or any other cause.
We may suspend or terminate your access to the app without notice if you breach these Terms, attempt to circumvent the app's in-app-purchase system, reverse-engineer the software, abuse the Apple refund process, or use the app in a manner that causes legal or reputational risk to the developer. You may stop using the app at any time by uninstalling it; uninstalling deletes all on-device data. Termination does not entitle you to a refund; refund requests follow Apple's refund policy.
We may update these Terms from time to time. Material changes will be announced in the app's release notes at least 14 days before they take effect. Continued use of the app after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. The exclusive place of jurisdiction for disputes with merchants is Berlin, Germany. If you are a consumer, mandatory consumer-protection laws of your country of habitual residence remain unaffected and you may also bring claims before the competent courts of your country of residence. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
